The only answer is to rewrite sec 35 of the constitution for more clarity. All the "treasonous separatist and Trump supporter" media rhetoric should be aimed at anyone who disagrees. Focus on this one constitutional clause and get it done.
I can't argue with you on that. But the problem is that constitutional amendments in Canada are degrees of magnitude harder than completing large projects. Just imagine how much fun it would be trying politically justify resetting the rights of hundreds of bands onside - not to mention Quebec.
In fact, I think pro development think tanks should actually go ahead and draft a proposed amendment to sec. 35, (taking advice quietly from a few pro-development indigenes) and publish it.
I think Quebec might well be sympathetic to clipping the wings of the bands. A focused amendment of Sec 35 only, using the 7/50 formula (sorry, Wab) could work - especially with Conservative premiers nearly everywhere. The problem is that the Liberals don't have the stomach for the political costs of solving the problem. (Or any actual desire to build any of these projects, but that's for another day)
And, as you imply, it would be possible to be fairly generous, as long as the result was clarity. Right now, everyone loses from lack of clarity. (As described many years ago in Heller's Gridlock Economy)
